Public Hearing Scheduled on Irrigation Rates & FinesThe Select Board, acting as Water & Sewer Commissioners, will hold an additional meeting on August 12th beginning at 5 p.m. in the large meeting room of the Town Office Annex, 261 George Ryder Road, to conduct a public hearing on proposed changes to the Town’s Water Rules and Regulations and to consider a new billing approach for irrigation water use (see more under Upcoming Public Hearings below). The discussion will focus on two key issues: - Amendments to the Water Rules and Regulations, Article VI.15.b.ii, which governs fines for property owners who fail to install a required second water meter for irrigation systems by holding those out of compliance more accountable with an enforceable timeframe to comply, with stricter penalties.
- Implementation of an estimated water usage split for properties with irrigation systems but without a dedicated irrigation meter. Under the proposal, these properties would be billed using a blended rate: 80% of total water use at the higher irrigation rate and 20% at the standard household rate, based on Town-wide consumption patterns. This change would take effect no sooner than the second summer quarter of 2025.
The proposed amendments are intended to encourage compliance with existing regulations, promote water conservation, and ensure fairness among all municipal water customers. The Water & Sewer Advisory Committee has reviewed and unanimously endorsed both the fine structure and the proposed 80/20 usage split.

Over Sand Vehicle UpdateChatham’s section of Nauset Beach, commonly known as North Beach, remains closed to Over Sand Vehicle (OSV) travel due to ongoing nesting activity by state and federally protected shorebirds, including multiple broods of Piping Plovers and Least Terns. Nesting extends across much of the beachfront, with active Plover nests and unfledged chicks still present. Both species are highly sensitive to disturbance during this critical breeding period. As a result, the Town cannot currently implement the vehicle access provisions outlined in its state-approved Habitat Conservation Plan (HCP). OSV travel requires specific protective measures that cannot be safely or effectively put in place under current conditions. While the Town of Orleans has reopened vehicle access on its section of Nauset Beach and is not using its HCP this season, nesting activity and habitat conditions can vary significantly from one section of the beach to another. In Chatham, the number and distribution of nests, particularly within the overwash zones preferred by Plovers and Terns, requires restricting OSV access to remain in compliance with the Massachusetts Endangered Species Act and the Town’s Habitat Conservation Plan. Daily monitoring by Natural Resources staff is ongoing. Based on current trends, the earliest possible reopening of any OSV routes in Chatham would likely be in early August, pending fledging of the majority of chicks and a reduction in nesting activity. Zach has five years of landscaping experience, most recently working as a Landscape Laborer for Backwoods Land Services in Eastham. He operated his own small landscaping business for four years before that. Originally from New Hampshire, Zach’s family moved to the Cape when he was five years old. He is a graduate of Cape Cod Regional Technical High School where he played basketball and baseball.

Meetinghouse Road Affordable HousingNext StepsThe application from Pennrose, LLC to construct forty-two (42) dwelling units in eight (8) structures on Town owned property at 0 Meetinghouse Road in South Chatham will be before the Zoning Board of Appeals (ZBA) on August 14th beginning at 2 p.m. The only action the ZBA will take will be to open the Public Hearing, as is required within 30 days of receipt of an application and continue it to September 4th. No testimony will be presented on the application on August 14th. Pennrose, LLC is requesting the grant of a Comprehensive Permit under M.G.L. Chapter 40B, Sections 20-23 and 760 CMR 56.00 and the grant of various waivers from regulations promulgated by the Chatham Zoning Bylaw, the Chatham Water & Sewer Department and other local regulations.

To consider placing two (2) temporary speed bumps on Kent Place during peak times, May through October, placed at the discretion of the Department of Public Works. August 12To consider amendments to the Water Rules and Regulations Article VI.15.b.ii, currently stated as: ii. On or After January 1, 2020 1. In the case of a first violation, a written Warning to the property owner of record by certified mail return receipt requested. 2. In the case of a second violation after 7 days have elapsed following a written Warning, a fine of One Hundred dollars ($100). 3. In the case of a third violation after 7 days have elapsed following a 2nd Violation, a fine of Two Hundred dollars ($200). 4. In the case of a fourth or more violation(s) after 7 days have elapsed following a third violation, shall result in disconnection of the irrigation system water meter. To be amended to read as follows: ii. On or After January 1, 2020 - For all irrigation systems that are noncompliant after this date, a written Warning to the property owner of record shall be sent prior to the imposition of any fines. Such letter shall set forth a requirement that the process for installation of a second meter, as prescribed by the water department, commenced within thirty days from the date of the letter, and completed within ninety days following commencement of the process.
- In the event that a property owner fails to comply with the foregoing requirements (either commencement of the process or installation of the meter), a fine of Three Hundred dollars ($300) may be imposed for each day of non-compliance.
- In addition to monetary fines, the Department, by and through the Select Board, may initiate suit in a court of competent jurisdiction to enforce the requirements of this bylaw. Such suit may include, but not be limited to, a request for an immediate disconnection of any irrigation system.
And; To consider implementing updated water rates no sooner than the start of the second summer quarter of 2025 for households with irrigation systems but without a separate irrigation meter to be billed based on an estimated usage split – 80% of total water consumption billed at the higher irrigation rate and 20% at the standard household rate, once the Town has the capability to implement such billing. August 19To consider a petition from NSTAR Electric Company d/b/a Eversource Energy to install one (1) manhole 10239/010 and 97’ +/- of 2-4” conduit. This construction is necessary to provide new underground service to the customer located at 38 Sandy Shoes Lane. To consider installation of two (2) rapid flashing beacons on Sam Ryder Road at its intersection with the Old Colony Rail Trail. Cape Cod Healthcare Blood DrivesCape Cod and Falmouth Hospitals are in urgent need of blood donations and will be holding numerous blood drives across the Cape in August to benefit Cape Cod Healthcare. Each unit of blood collected lasts only 42 days, so it is a constant challenge to maintain sufficient supply at each facility. All blood collected at Cape Cod Hospital blood drives help our families, friends, and neighbors.
